1. Acceptance of Terms

By accessing or using Exposurix ("the Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this Service.

2. Authorized Use Only

YOU MUST ONLY USE THIS SERVICE FOR AUTHORIZED AND LEGAL PURPOSES.

You agree to:

• Only scan systems you own or have explicit written permission to test
• Use tools for educational and authorized security testing purposes only
• Comply with all applicable local, provincial, federal, and international laws
• Respect the privacy and security of others at all times

You agree NOT to:

• Conduct unauthorized penetration testing or network scanning
• Access, probe, or attack systems without explicit permission
• Violate any cybersecurity laws including Canada's Criminal Code Section 342.1, the CFAA, or equivalent legislation
• Use the Service to harass, stalk, or harm any individual or organization
• Redistribute, resell, or commercialize scan results without authorization

3. User Accounts

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 18 years old to use this Service
• You are responsible for all activity that occurs under your account
• You must notify us immediately of any unauthorized use of your account

4. Subscription and Payment

• Subscriptions are billed monthly or annually depending on your chosen plan
• All prices are in Canadian Dollars (CAD) unless otherwise stated
• Payments are processed securely through PayPal or NOWPayments (crypto)
• We do not store credit card or payment details on our servers
• Subscriptions automatically renew unless cancelled before the renewal date
• No refunds are provided for partial billing periods
• You may cancel your subscription at any time from your account settings

5. Free Trial

New accounts may be eligible for a limited free trial of Pro features. Trial terms, duration, and eligibility are subject to change at our discretion. After the trial period, your account will revert to the Free tier unless you subscribe to a paid plan.

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Exposurix. Our trademarks may not be used in connection with any product or service without the prior written consent of Exposurix.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Guarantees of uninterrupted or error-free service
• Accuracy or completeness of scan results or breach data
• That the Service will meet your specific security requirements

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXPOSURIX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

9. Indemnification

You agree to indemnify and hold harmless Exposurix and its operators, employees, and affiliates from any claims, liabilities, damages, losses, and expenses arising from your use or misuse of the Service, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

We reserve the right to suspend or terminate your account immediately and without notice if you:

• Violate these Terms of Service
• Engage in any illegal activity using the Service
• Abuse the platform, its APIs, or rate limits
• Attempt to gain unauthorized access to any part of the Service

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting an updated version on this page with a revised "Last Updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Quebec, Canada, without regard to conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Quebec, Canada.
